Living Proof Creative (“Living Proof Creative,” “we,” “us,” or “our”) is a creative and digital agency based in Austin, Texas. For 12 years, we have built our business on trusted relationships with clients, partners, and the people who visit our website. We take that trust seriously, including the responsibility to handle personal information thoughtfully and transparently.

This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit livingproofcreative.com or another website or online service that links to this Privacy Policy (collectively, the “Site”), contact us, subscribe to communications, or otherwise interact with us in connection with our business.

This Privacy Policy does not apply to information we process on behalf of a client while providing agency, hosting, development, analytics, marketing, or related services. In those situations, the client controls the information and its privacy notice governs. See Client Services and Information We Process for Clients below.

Personal Information We Collect

The personal information we collect depends on how you interact with us.

Information You Provide

We may collect information you choose to provide, including:

Do Not Track and Global Privacy Control

Some browsers offer a “Do Not Track” setting. Because there is not a uniform industry standard for responding to Do Not Track signals, the Site does not currently respond to them. Where required by applicable law, we treat a recognized opt-out preference signal, such as Global Privacy Control (GPC), as a request to opt out of the sale or sharing of personal information or the use of personal information for targeted advertising for the browser or device that sends the signal.

We do not sell personal information for money. Certain privacy laws define “sale,” “sharing,” or “targeted advertising” broadly enough that some disclosures involving analytics or advertising technologies may fall within those definitions. Client Services and Information We Process for Clients

As a full-service creative and digital agency, we may handle personal information on behalf of clients when providing services such as website design and development, hosting, ecommerce support, analytics, search engine optimization, digital marketing, campaign management, or technology consulting.

For that information, Living Proof Creative generally acts as a service provider or processor and follows the client’s documented instructions and our agreement with that client. The client determines why and how the information is processed, and the client’s privacy policy applies. If your request concerns information associated with one of our clients, please contact that client directly. If you send the request to us, we may forward it to the appropriate client where permitted.

Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including to maintain a business relationship, provide services, meet contractual commitments, comply with legal or accounting requirements, resolve disputes, enforce agreements, and protect our business.

Retention periods vary based on the type of information, our relationship with you, the sensitivity of the information, applicable legal requirements, and whether the information is needed for security or dispute resolution. When personal information is no longer needed, we take reasonable steps to delete, de-identify, or securely dispose of it.

Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No website, transmission, or storage system can be guaranteed to be completely secure, however, and we cannot guarantee the absolute security of information submitted to or processed by us.

If we deny a request and applicable law gives you a right to appeal, you may appeal by replying to our decision or emailing the same address with the subject line “Privacy Appeal.” You may also use an authorized agent where permitted by law. We may require proof of the agent’s authority and may need to verify your identity directly.

California Privacy Notice

California residents may have rights under the California Consumer Privacy Act, as amended (CCPA), if it applies to Living Proof Creative. The categories of personal information we may collect include identifiers; customer records information; commercial or business relationship information; internet or other electronic network activity; approximate geolocation; professional or employment-related information; audio, electronic, or visual information you provide; and inferences drawn from other information.

We collect these categories from the sources and for the purposes described above. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA. We do not knowingly sell or share the personal information of consumers under 16.

Additional Information for Individuals Outside the United States

If privacy law in your location applies to our processing, our legal bases may include performing a contract or taking steps at your request before entering a contract, pursuing our legitimate interests in operating and improving our business, complying with legal obligations, and obtaining your consent where required.

You may also have the right to object to or restrict certain processing and to lodge a complaint with your local data protection authority. If you withdraw consent, that withdrawal does not affect processing that occurred before the withdrawal.

Living Proof Creative is based in the United States.
